DISCUSSION: The visa petition was initially denied by the Director, Nebraska Service Center. The petitioner filed a Form I-290B, which was treated as a motion by the Director. The matter was also appealed to the AAO. On January 12, 2012, the petition was approved on motion, which renders the separate appeal before the AAO moot.

    ORDER: The appeal is dismissed based on the approval of the underlying petition.
